For many organisations, cyber-attacks have become inevitable rather than an unlikely occurrence.  Threat actors have developed more sophisticated approaches, and it’s important for in-house legal teams to understand how to respond. This session will focus on a cyber-attack scenario and consider how an in-house team should respond at each step.

  • What should you do in the first 24 hours after an attack?
  • How should you engage with a ransom and the attacker?
  • Who do you need to inform?
  • What actions can you take that could help prevent a data breach and/or litigation being brought against you? Is there anything you can do once an attack has happened?
  • Should you accept the inevitability of litigation over a data breach, or should you develop a strategy to mitigate this risk?
  • How should in-house firms be thinking about their cyber insurance policies, which often cover the cost of the incident rather than any ransom?
